An Ebute Meta Magistrates’ Court in Lagos on Friday ordered mental examination of a Nigeria Customs Service man who was alleged to possess a liquid suspected to be acid.
The Magistrate, Mrs Joy Ugbomoiko, gave the order after Cletus Chibuzor was arraigned on a two-count charge of unlawful possession and breach of peace.
She also remanded the defendant at the Ikoyi Prisons, pending the confirmation of his mental state.
"The defendant should be remanded and not to be granted bail until the adjourned date.
"His mental state should be confirmed in the prisons before the next adjourned date," Ugbomoiko ordered.
The prosecutor, Insp. Idowu Onime, had told the court that the defendant had in his possession a chemical substance suspected to be acid on June 8.
"Also in his possession was one container of tear gas.
"He instilled fear on members of Wazobia Cool F.M Radio Station situated at Etim Iyang Crescent on Victoria Island,’’ Onime said.
He told the court that the defendant was attached to the Tincan Island Command of the Nigeria Customs Service and that the service confirmed that he was mentally ill.
Although, the prosecutor presented a letter from the service to that effect, the court did not accept it but requested Chibuzor’s mental examination by a medical expert.
Onime said that the address of the defendant had not been known.
He noted that the offences contravened section 338 and 404 of the Criminal Code Laws of Lagos State, 2011.
The court adjourned the case till Sept. 12 for the confirmation of the mental state of the defendant.
